LEGAL STAY IN THE REPUBLIC OF LITHUANIA

To stay in Lithuania for more than 90 days you must acquire national visa or temporary residence permit.

Also, you can receive a national visa for the duration of consideration of your application for a temporary residence permit (maximum term – 5 months).

National visas are issued for the duration of no more than 1 year.


If a foreigner had been granted a 1-year multi-entry national visa, another multi-entry national visa may only be issued after more than 180 days have passed since expiration of the previous visa.

Request for the issue of national visa must filled in the application on the website: https://visa.vrm.lt/epm.

Application for the issue of a national visa and accompanying documents are submitted to the Lithuanian visa authority in a foreign country or through an external service provider.

Application for the issue of a national visa is submitted in Lithuanian Visa Service if a foreigner has a document proving his legal status in the country (e. g., applying for a national visa for the duration of consideration of your application for a temporary residence permit).

Usually, a TRC is issued for 1, 2 or 3 years, depends on a ground of TRC. Also, it may be issued for a shorter period.

Application for the issue of temporary residence permit is submitted electronically through MIGRIS system. After submission of application and after booking the visit time through MIGRIS, you will need to apply for a temporary residence permit (renewal) in person within 4 months from the date of submission of the application to the MIGRIS and submit the biometric data and original documents to Territorial division of the Migration department or Lithuanian Embassy if you are abroad

For the acceptance, examination of application for temporary residence permit and decision-making and issuing of a temporary residence permit you will be asked to pay (state taxes):

  1. 120 Eur, decision will be made within 4 months.
  2. 240 Eur, decision will be made within 2 months.

For the acceptance, examination of application for national visa and decision-making and issuing of a national visa you will be asked to pay 120 Eur (state taxes). The decision to issue a national visa is made within 15 calendar days from the date of the request. This period may be extended by up to 45 calendar days.

Living in the Republic of Lithuania for 5 years with a temporary residence permit allows a person to apply for a long-term residence permit.

The term of 5 years does not include periods when a person lived in Lithuania based on:

  1. Visa-free Travel Regime;
  2. any type of visa, including Schengen visa;
  3. TRC, given by other country of EU or Schengen.

If a person studied in Lithuania in a scientific or studies institution, to an educational institution under a general education or vocational training program or have been invited to upgrade a qualification to a higher science and study institution, only half of his/her stay based on studies, training or qualification improvement under the temporary residence permit is included in the period of your living in Lithuania. This provision does not apply if a person has completed studies in the Republic of Lithuania and has acquired a higher education qualification and can submit a document certifying it.

If a person was granted additional protection in the Republic of Lithuania, the period of his/her stay in Lithuania includes half of the time that elapsed between the date of application for asylum in the Republic of Lithuania and the date of issue of the temporary residence permit on that basis, or the whole of that time if it lasted more than 18 months.
During persons’ stay in Lithuania he/she can travel abroad for a short time, but trips from the territory of Lithuania may not last longer than 6 months in succession and may not exceed 10 months in a consecutive and total period of 5 years.
The period of residence is interrupted by the time of serving a sentence imposed by the court.

Also, there is a procedure for persons asking a PRC on a family merge ground. If you have entered the Republic of Lithuania together with a citizen of the Republic of Lithuania as a member of his family, you may obtain a permanent residence permit. It is considered that you arrive together if you have lived together with a Lithuanian citizen as his family member in a foreign country and all of you are moving to live in Lithuania together. You must be moving from any non-EU/EFTA country.

With an application for TRC a person must submit following documents:

  • A valid travel document (passport);
  • A document confirming that a person has enough funds in order to survive in the Republic of Lithuania (e. g., a bank statement, contract of employment);
  • A document about a place of residence in the Republic of Lithuania (possible to provide it only after the decision to give TRC is made);
  • A certificate regarding (the absence of) a criminal record (if a person is older than 14).
  • A document confirming that a person has a health insurance (insurance coverage 6 000 EUR);
  • Documents confirming legal stay if application is submitted in Lithuania (e. g., visa, TRC, asylum seekers card)

AND

documents confirming the ground for issuance of temporary residence permit.

With an application for a national visa the person must submit following documents:

  • A photograph;
  • A document confirming that a person has enough funds in order to survive in the Republic of Lithuania (e. g., a bank statement, contract of employment);
  • A document confirming that a person has a health insurance (insurance coverage 30 000 EUR);

Most common grounds on issuing national visas are:

  • Employment (a person must have a work permit issued by the Employment Service and a mediation letter (invitation) from an employer)
  • Education (recommended for studies which does not exceed 1 year; a person must have a mediation letter electronically submitted by the higher school through the Lithuanian Migration Information System (MIGRIS));
  • Legal activity (for manager or shareholder of the company registered in the Register of Legal Entities, established not earlier than one year before the date of application for a national visa, if the value of company’s equity (for non-public limited companies and non-private limited companies – assets) is at least 28 thousand euro);

Most common grounds on issuing temporary residence permits are:

  • Family reunion (e.g., your child or spouse, who are citizens of Lithuania, live in Lithuania);
  • Employment (e. g., you work under an employment contract and a have a decision from the Employment Service stating your work meets the needs of the Lithuanian labor market);
  • Education (e.g., for studies which exceeds 1 year period; A person must have a mediation letter electronically submitted by the higher school through the Lithuanian Migration Information System);
  • Legal activity (for a manager or a shareholder of a company that, for at least the last 6 months before my application for a residence permit, in accordance with the business plan in the Republic of Lithuania carries out the activities specified in the founding documents of the company, where the citizen of the Republic of Lithuania, other EU Member States or EFTA Member States, or foreigners permanently resident in the Republic of Lithuania are employed full-time, and whose salaries in total are at least 2 monthly average gross earnings of the employees of the country’s economy in the last quarter published by the Lithuanian Department of Statistics (including the information on earnings in private enterprises); the value of equity (for non-AB and non-UAB – assets) is not less than 28,000 EUR, whereof at least 14,000 EUR are invested funds or other assents of a manager, or at least 1/3 is owned by a shareholder of AB or UAB; ).

ILLEGAL STAY IN THE REPUBLIC OF LITHUANIA

An alien must leave the Republic of Lithuania before the expiry of the period of validity of a visa or temporary residence permit. When a foreigner overstays this period, his or her stay becomes illegal and a decision to return him or her to a foreign state is made.

There can be two types of decisions (based on circumstances of which foreigner’s stay became illegal):

  1. A decision to return an alien to a foreign state. A decision determines a period of between 7 to 30 days from the service of the decision to the alien and within which the alien is obliged to voluntarily leave the Republic of Lithuania.
  2. A decision to expel an alien from the Republic of Lithuania. A decision to expel an alien from the Republic of Lithuania will be enforced after it comes into force (14 days after the decision is delivered to a person). In this case, expulsion will be carried out forcefully by the State Border Guard Service.

The obligation to leave the Republic of Lithuania can be prolonged for exceptional circumstances but cannot exceeding 60 days during which an alien must leave the Republic of Lithuania.

Most likely a person who is obliged to leave Lithuania voluntarily will not be a subject to an entry ban prohibiting an entry into the Republic of Lithuania for a period not exceeding five years (unlike when a decision to expel is made). Also, after a decision to expel a person is made, there may be an additional decision made – detaining an alien in Foreigners registration (detention) center until expulsion is finalized.

The term of an entry ban prohibiting the entry into the Republic of Lithuania is started to count after a decision of expulsion is executed.

Under specific circumstances (e.g., marriage with a citizen of the Republic of Lithuania, a newborn child who is a citizen of the Republic of Lithuania) there can be a ground to apply with a request asking to shorten the ban of an entry or to annul it.
